Introduction and Scope
DP World (“we,” “our,” “us”) processes your personal information to facilitate the operations of the Cargoes Driver App (“App”). This privacy notice describes what personal information we collect, how we use it, why we use it, and your rights regarding this data. We are the data controller of your personal information as we determine the means and purposes for which your personal information is processed.

This privacy notice applies to all drivers using the Cargoes Driver App (“you,” “your”).

1. Where We Collect Your Personal Information From

We collect personal information from the following sources:

User Input: Information provided by drivers during the sign-up process or by driver managers.
Automated Processes: Data collected via the App’s functionalities, such as geolocation tracking.
Checklists: Health and wellness checks before trips.

2. Why/How We Use Your Personal Information and the Legal Basis for Processing

We collect and process different types of personal information for the following purposes:

3. Data Sharing and Disclosure

Internal Use: Personal data is stored in the Cargoes TMS application and accessed only by authorized personnel based on their job roles.
Third-Party Sharing: Limited to customer representatives for pick-up and delivery coordination.
Data Hosting: The App is hosted on DP World Cloud, built on Microsoft Azure, with data accessed from UAE, India, and SSA regions (Kenya, South Africa, Namibia).

4. Data Security

We have put in place appropriate security measures to prevent your personal information from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal information to those employees, agents, contractors and other third parties as detailed in ‘Disclosing, Sharing and Disclosure’ above. They will only process your personal information on our instructions, and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal information breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

5. Data Retention

We retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To help us work out the appropriate period for retaining your personal information, we think about the amount, types, and sensitivity of the personal information, the potential risk of harm caused from unauthorised use or disclosure of your personal information, the purposes for which we process it and our legal requirements.

6. Data Subject Rights

In certain circumstances, data protection laws governing DP World’s processing of your personal information may grant you certain rights related to your personal information. These rights are summarized in the table below

Right to access and data portability. You have the right of access to information we hold about you and/or to have it transferred to another data controller in some circumstances
Right of rectification or erasure. If you feel that any data that we hold about you is inaccurate you have the right to ask us to correct or rectify it. You also have a right to ask us to erase information about you where you can demonstrate that the data we hold is no longer needed by us, if you withdraw the consent upon which our processing is based, or if you feel that we are unlawfully processing your data. Your right of rectification and erasure extends to anyone we have disclosed your personal information to, and we will take all reasonable steps to inform those with whom we have shared your data about your request for erasure
Right to restriction of processing. You have a right to request that we refrain from processing your personal information, where you contest its accuracy, the processing is unlawful and you have opposed its erasure, where we do not need to hold your personal information anymore but you need us to in order to establish, exercise or defend any legal claims, or we are in dispute about the legality of our processing your personal information
Right to object. You have a right to object to our processing of your personal information. This includes the right to object to the use of your information for direct marketing and profiling purposes
Right to withdraw consent. You have the right to withdraw your consent for the processing of your personal information where the processing is based on consent
Challenge Automated decision making. You have the right to challenge a decision based solely on automated processing
Right to complain. If you are unhappy with the way we have used or are handling your personal information you have the right to lodge a complaint with the supervisory authority for data protection issues in the country where you usually live, work or where the relevant issue arose. We do, however, appreciate the chance to deal with your concerns before you approach the supervisory authority, so please contact us in the first instance at the email set out below

Please note that some of these rights are limited by data protection law and we have the right to collect, process and store your personal data to perform our legal obligations.

7. Data Minimization and Accuracy

Minimization: Systems are designed to collect only necessary data.
Accuracy: Managers validate personal information during onboarding and ensure it remains up to date.

8. Cross-Border Data Transfers

Where we transfer your personal information to third parties outside of the jurisdiction you are in, we shall do so only where there are adequate provisions to ensure your privacy. Where the jurisdiction is not considered adequate by the relevant authorities, we put in place alternative contractual measures including standard contractual clauses approved under the relevant laws.

9. Updates to This Privacy Policy

We may update this policy periodically. Significant changes will be communicated through the App or via email. The updated policy will include a new “effective date” at the top.
